What are your rights when you quit your job?

Deciding to quit a job can be complicated and very stressful, especially if you are new to this process. California law indicates that a worker can quit a job at any time he wishes, without facing any problem or consequence. However, if you have a fixed-term contract, resigning before the end of the determined period can have some consequences.

It is generally advisable to give your employer at least two weeks’ notice when you decide to resign. This is with the purpose that he has the opportunity to find his replacement and take care of the necessary paperwork. But, it is important to note that this advance time is not stipulated by law. Therefore, you could resign when you see fit and stop working at the company without having a legal problem.

If you have notified your employer at least 72 hours in advance, on your last day of work, he must pay you for the days worked that are still pending. On the other hand, if you did not provide timely notice, your employer must make your final payment within 72 hours of your last business day. If this is not the case and your employer has not paid you after 72 hours, your employer could suffer consequences. The consequences can be monetary and will grow the equivalent of one day of your salary for each day that your employer is late.

Finally, it is important to know that you still have the right to start a claim after you quit your job if your rights have been violated. This claim will have the same validity regardless of your resignation.
